In every Florida community, there are children on the roads, sidewalks, and driveways riding bicycles. It is vital that all motorists and drivers in the State of Florida drive with caution and be on the lookout for bicyclists especially children and teens. Speed limits, traffic signs, and signals should be obeyed by drivers. Unfortunately, at times, drivers exceed the posted speed limits or run stop signs or red lights. When this happens, a child, who is riding a bicycle, can be injured. Some children even lose their lives due to the careless or negligent driving of others. When a child dies as a result of a Florida Bicycle Accident, the parents of the child have legal rights that can be pursued and enforced through a Florida Wrongful Death case. No parent should ever have to bury a child especially when the death or incident was wholly avoidable. In Florida, parents have a right to pursue a case or claim for compensation and damages pursuant to Chapter 768, Florida Wrongful Death Act.
Cases for the Wrongful Death of a child can be quite complex. Because of this, it is important for parents to contact a Florida Child Injury Lawyer for advice, consultation, and legal representation. There are also some very good resources and materials out there for parents to read to educate themselves on Florida law and in particular the Florida Wrongful Death Act.
