Colton Hutchinson – Accidentally Shot and Killed by Friend in Cape Coral Home – Gun Safety, Criminal Responsibility and Liability


Colton Hutchinson, age 14, was accidentally shot to death in the friend’s home in Cape Coral, Florida. The father (David Casman) of the child, who discharged the weapon, was charged with culpable negligence for failure to secure a loaded gun. The .38 caliber gun apparently was not secured to keep it out the hands of curious and careless teenagers who some times lack the good judgment and experience to hand fire arms / guns. Many children and adults for that matter suffer serious personal injuries and deaths from accidental shootings every year. Many of these instances take place when a child get his or her hands on a gun that belongs to a parent but is not properly locked up or otherwise secured to be out of the reach of children.

This tragic wrongful certainly takes a toll on both families involved as well as the community as a whole. It also illustrates the importance of securing all firearms and guns away from children. A few moments and a few dollars used to properly secure a home can literally safe the life of a child or an adult who is the unfortunate victim of an accidental shooting.
