Train on Florida East Coast Railway Kills Three Teen Girls Crossing Florida Bridge

In Florida, families in and near Melbourne are mourning the tragic railroad related deaths of three teens. The tragedy took place near downtown Melbourne. What started out as a normal day at a mall for the teens turned into a terrible and preventable accident. The incident was even witnesses by several people who could only look and shout with horror as the event was unfolding in front of them. It was reported that there was a No Trespassing sign near the area which included a railroad trestle that spanned 200 feet over a creek. Unknown to the teens at the time that they got on the tracks, a train was nearby and pounding down the tracks. Of the four teens on the tracks, only one was able to escape for safety.

It was reported that the teens even ignored the warnings of a local fisherman who was in the area at the time. Railroad tragedies of this nature are far too common. Since there were deaths that resulted from this incident, a full investigation will be conducted which may involve answering or addressing the following questions:

What the the speed of the train prior to and at the time of the incident?

What was the speed limit in the area?

Were the tracks and adjacent area properly constructed and maintained per railroad regulations?

Was the incident avoidable if additional measures were taken prior to the incident?

What was the visibility at the time of the incident?

Were there prior problems with teens or others in or on this area of the tracks in the past?

Had the teens themselves been in this area before?

Middleburg (Clay County), Florida School Bus Accident: Injured Children and Two Deaths

In Middleburg, Florida and other parts of Florida, all drivers should exercise due caution when driving near school buses. Children are at risk for personal injuries in school bus accidents. While most school buses are large and yellow or orange in color, many drivers on Florida roads still fail to notice or yield to school buses. Not only is this dangerous to children - it is also quite dangerous to any driver / passengers crashing into the typical school bus which is a large and heavy vehicle. A tragic accident took place in Clay County Florida when a Pontiac sedan failed to stop as a school bus was turning. Two people died as a result of the accident and at least four children were treated for non life threatening personal injuries. State of Florida - 3rd in Nation for Pedestrian - Train Deaths

In Florida and other States, pedestrians are the unfortunate victims of train related deaths. Statistically, Florida ranks 3rd among all States for train / pedestrian deaths. Georgia ranks 11th. Train companies as well as child and safety experts agree that both train companies and employees as well as pedestrians should exercise due caution due to the serious dangers created by pedestrians walking on or near railroad tracks. It is recommended that pedestrians should stay 25 feet or more from train tracks due to the size of the train, cargo, and the risk of flying debris as the train moves through the area. Disney World Monorail Accident Causes Death of Employee / Cast Member

The Walt Disney World Monorail System has enjoyed a relatively good safety record over the year and there have been no deaths reported from the monorail system until just recently. Tragically, a 2 a.m. crash between two monorail trains left an employee / cast member dead and another employee / cast member with personal injuries requiring medical attention. The crash took place on one of the last runs of the day. The trains were transporting guests from Epcot Center. South Florida Toddler Remains in Critical Condition After Falling off of Train Ride at Southland Mall - What Safety Measures Were In Place?

A toddler is in critical condition after falling off a train ride at the Southland Mall in Dade County, Florida. The toddler was on an electric train at the Southland Mall and for some reason fell off of the ride and suffered a head injury and trauma. Paramedics from Dade County or Miami Fire Rescue arrived on the scene to find a mother who was very upset and stressed over the injuries to her young son. The Southland Mall management shut down the ride for inspection by the Department of Insurance. The toddler was rushed to Miami Children's Hospital for admission. The incident was reported in the news but there are several questions or issues that come to mind on a serious personal injury matter like this.

What kind of train was it?

What the the speed of the train at the time of the incident?

What safety measures were taken by the mall and / or ride operator to insure the safety of young children while on the train ride?

What seat belts or safety harnesses were in place at the time of the incident?

Was the toddler riding alone, with his mother, and / or with others?

Have there been any other incidents with this train in this mall or other malls?

Man Killed While Sitting on Railroad Tracks in Tampa, Florida

Any accident / incident involving a train can result in serious injuries or death. The Hillsborough County Sheriff's Office recently reported that a 46 year old man (Antonio Francisco) was killed as he was sitting on railroad tracks in Tampa, Florida. A relative reported that Mr. Francisco may have purchased alcohol earlier in the evening and may have been sitting on the tracks while drinking. Railroad tracks are not a good place to drink, eat, or sit for any adult or child for that matter. Since trains sporadically run over many railroad tracks, many pedestrians do not appreciate the dangers of the trains. Even if the train is on a rigid schedule, many pedestrians still do not appreciate or realize the dangers of trains. A full investigation by the Federal Railroad Administration will be conducted to determine the cause of the railroad / train related death and if any actions on the part of the railroad could have been taken to avoid the tragic and untimely death of Antonio Francisco. Traumatic Brain Injury - The Injured Child in Florida - What is a traumatic brain injury?

Florida children acquire or are inflicted with traumatic brain injuries from automobile accidents, playground incidents, day care injuries, slips and falls, sports related injuries, and other causes. Some refer to traumatic brain injury (TBI) as a brain injury or head injury. Traumatic brain injury is caused when sudden trauma damages the brain. Traumatic brain injury occurs when the head suddenly and violently hits an object or when an object goes through or pierces the skull and damages the brain tissue. Symptoms for traumatic brain injury can range from mild to moderate to severe. Some victims of traumatic brain injury experience loss of consciousness and others do not. Other symptoms of traumatic brain injury include the follows: headache, light headedness, dizziness blurred vision, tired eyes, ringing in the ears, bad taste in the mouth, mood change, lethargy, change in sleep patterns, memory problems, concentration problems, attention, and thinking and cognitive defects.

Some children who sustain a traumatic brain injury are affected for life. Since the brain is very fragile, treatment for traumatic brain injury can be quite limited. It is important to get evaluation and treatment for traumatic brain injury by professionals including but not limited to neurologists, neurosurgeons, psychologists, psychiatrists, and / or neuro-pscychologists. Who is considered a child under Florida's Wrongful Death Act?

When there is a wrongful death in Florida, a spouse and minor children can recover damages for mental pain and suffering and for lost parental companionship due to a parent's death. Under Florida's Wrongful Death Act, a minor child is defined as a child under 25 years of age. If there is no surviving spouse or the decedent was divorced at the time of death, then adult children can recover damages for mental pain and suffering and lost parental companionship. Dangers of Jacksonville Florida Trains - Star Football Player Dies

A Clay County Florida teen, Wesley Whiddon, 17, died as a result of injuries sustained after being hit by a train.

Wesley and friends were fishing on a bridge on private property over Black Creek when a train approached the area. Two friends were able to avoid the train. Wesley did not. Although Wesley was a star football player - he was not match with the train. Investigation is under way regarding this incident. Mary Maraghy, a Jacksonville Times Union reporter, wrote that the No Trespassing Signs were posted in the area. Wesley was well liked and had a bright future ahead of him. The tragedy ended a life on unfulfilled potential.
