Rain and Weather Conditions Cause Older Driver to Hit Younger Pedestrians Causing Serious Injuries

The Florida Times Union reported that two teenagers (Malik Lee - age 13 and James Nelson - age 16) were recently hit by an older driver in Baker County. It was reported that a 92 year old driver was driving on County Road 139 when the incident took place. The incident took place at 8:00 p.m. in the evening. The teenagers were taken to Shands Jacksonville for treatment and evaluation of serious personal injuries. St. Augustine, Florida Toddler Hospitalized After Being Hit by Car at Trailer Park

A toddler was recently hospitalized after being hit by a a vehicle at the Coquina Oaks Trailer Park in St. Johns County, Florida. The driver, Preston Storey, informed the St. Johns County Sheriff's Office that he did not see the child as he was driving out of the trailer park. Florida - Most Dangerous State for Bicyclists - Personal Injuries and Wrongful Deaths on Florida Roads

Florida has the highest number of fatalities of bicyclists compared with other States. According to the National Highway Traffic Safety Administration, there were 113 bicyclists who died in Florida in 2008 and 121 bicyclists who died in 2007. These figures are quite disturbing when evaluating the numbers for Georgia, the state adjacent to Florida, had 16 deaths in 2007 and California, which is a larger and more populated state, had 109 deaths in 2007.

Florida drivers should take due care when driving near bicycle paths and bicyclists. This is especially true for child bicyclists.

Florida Company (Safety Animated, Inc.) Promoting Safety of Areas / Streets Where Children Are At Play

Many child injuries and deaths resulting from automobile accidents involving bicyclist and child pedestrians can be avoided. Drivers in residential neighborhoods, school zones, and any other areas with children should proceed with due care and caution. Children do not always have the best of judgment or the best sense of danger when playing sports / games or when biking. Parental supervision is vital to the safety of children. It is also helpful to have safety signage in place to alert and / or remind drivers that there are children in the area. Safety Animated, Inc. is a great company based in Tampa, Florida. The mission of the company is to promote the safety of children. Safety Animated sells safety signage as a visual reminder to drivers to slow down, be on the look out, and exercise the utmost caution because children in the area.

Parents, day care centers, schools, and recreational facilities should truly consider this product. The signage can certainly help prevent or at least reduce the number of personal injuries resulting from driveway and roadway injuries caused by driver inattention, driver distraction, and /or a child's negligence. As every one knows, children can be careless at times and run into a road way. If drivers are proceeding at a slower speed with due caution, it will be easier to stop and avoid a tragedy.

South Florida Christian Preparatory Student (Elizabeth Codie Lewis) Dies in Automobile Accident on Florida's Turnpikes - Negligence, Liability, and Seat Belts

In Florida and other States, class road trips to Universal Studios, Walt Disney World, and Sea World can be great fun. Some class road trips, however, turn out to be tragic. Recently a South Florida high school student (Elizabeth Codie Lewis - age 17) from South Florida College Preparatory School died in an automobile accident on the Florida Turnpike. She was the passenger in a vehicle driven by Livingston James Finely. Florida Highway Patrol reported that Finely probably fell asleep and lost control of the vehicle. Many others were injured in this crash as well.

No passengers were wearing a seat belt. It is disturbing that not one person was wearing a seatbelt. However, this may have no impact on a potential legal case. In order for the failure to wear a seat belt to be valid defense, it must be shown that there was an available and operational seat belt and that that seat belt would have more likely than not prevented an injury or lessened the severity of the the injury. If the impact of the accident would have caused Elizabeth to die anyway, the failure to wear a seat belt is irrelevant for a potential civil or insurance claim.

It is uncertain if this was a school sponsored trip or what kind of supervision was involved with this road trip. It is truly sad that a young high school student with some much promise lost her life on Florida roads.

Bicyclists Injured Riding on Old St. Augustine Road in Jacksonville, Florida.

Florida counties, cities, and municipalities establish bicycle lanes for the use and safety of bicyclists. Drivers have a duty to yield to bicyclists utilizing these specially designated bicycle lanes. Unfortunately, some drivers fail to observe or visualize bicyclists in the these lanes and drive into the lanes while they are occupied by bicyclists. On Old St. Augustine Road, Chastity Rettinger, age 36, and another bicyclists were in the designated bicycle lane when they were hit by a driver who switched lanes. Tragically, Chastity Rettinger died at the scene. A homicide investigation will be completed by the Jacksonville Sheriff's Office and / or the Florida Highway Patrol to determine the cause of the accident. An autopsy may be performed to determine the cause of death which would appear to be the trauma from the incident.

All drivers are encouraged to yield to bicyclists especially children. Saving a life and avoiding serious personal injuries are much more important than saving time by getting somewhere quicker. Be on the lookout for all pedestrians, bicyclists, and other drivers. Their lives depend on your attention and safe driving habits.

Jacksonville Florida Automobile Accident Leaves 2 Drivers Dead and 1 Injured

In Jacksonville, Florida and other cities in Florida, multiple vehicle accidents can lead to numerous injuries and death. Recently, an automobile accident in Jacksonville, Florida led to the deaths of two drivers and the injury of another in a three vehicle crash on State Road 9A in the Arlington area of Jacksonville. According to reports from the Florida Highway Patrol, a 60 year old driver was Lake Wells switched lanes and crashed into another vehicle. This caused one of the vehicles to cross over a median and crash into a Toyota SUV heading in the opposite direction. The victim in the Toyota SUV was identified as 21 year old - Jimmy Paul Le. Ali Reza Navazesh suffered minor injuries in the accident.

Some accidents are unavoidable. Other Jacksonville, Florida automobile accidents result from inattention and negligence. Some drivers are in such a hurry to get to his or her destination. Time or saving time is then given a greater priority than safety. Five Teens and Four Children Injured in Putnam County, Florida Automobile Accident

In Satsuma, Florida, ten people were injured as a result of a two vehicle crash. There were 9 teens and children injured in this unfortunate crash. The automobile accident took place at approximately 8:25 p.m. The crash report indicated that Dustin Harris, a 16 year old from Satsuma ran a stop sign and crashed into a Dodge Van vehicle being driven by Carmen Bass. Several of the injured occupants were not wearing a seat belt at the time of the crash. The passengers in the vehicles were identified as: Dillon Harris (age 16), Kelsey King (age 18), Lisa Huntley (age 18), Beautiful Pemberton (age 11), Cheyenne Phillips (age 13), Alyssa Edwards (age 10), Madison Phillips (age 9), and Hansond Pemberton (age 14). The teens /children were either from Satsuma or Pomona Park.

It is important for teen drivers and all other drivers to obey the basic rules of the road including following street signs and traffic devices. The seat belt is an important safety device that should be worn by all occupants especially children. While the failure to wear a seat belt does not preclude the accident victim from seeking compensation or filing a lawsuit, the failure to the wear a seat belt may end up mitigating or reducing damages by the extent that the seat belt either would have prevented injuries or reduced the seriousness of injuries.

Dangers of Drowsy Drivers - Risks of Accidents and Personal Injuries in Florida

The National Highway Traffic Safety Administration (NHTSA) reports that approximately 80 % of all accidents involve some sort of driver inattention. A great many of these accidents involve drivers who are fatigued and sleepy. The National Sleep Foundation, a non profit Washington based advocacy organization, estimates that over 50 % of adult drivers have driven while drowsy. As such, there have been millions of drivers out there who get behind the wheel drowsy and tired. This, of course, presents a risks to the drivers, passengers, other drivers, pedestrians, and bicylists.

It is difficult to determine the number of accidents that are caused on a daily, weekly, or annual basis due to sleep deprivation or drowsiness in Jacksonville, Florida since the Jacksonville Sheriff's Office does not maintain this kind of information or database. Nevertheless, sleep deprivation and drowsiness do cause inattention, which in turn, cause accidents and resulting personal injuries.

Melbourne Beach, Florida Man (Edward Kronemeyer) Dies in Fiery Crash in St. Johns County, Florida

A rear end accident caused the death of a Melbourne Beach, Florida man (Edward Kronemeyer) in St. Johns County, Florida. The crash took place on Interstate 95 Southbound near Florida State Road 16. Mr. Kronemeyer's 1966 Triumph convertible was rearended by a Sport Utility Vehicle (SUV) driven by Vonnier Queen of Jacksonville. The rear end crash pushed Mr. Kronemeyer's vehicle off the East shoulder of I 95 and went into the woods striking several trees. As a result of the crash, the Triumph was set on fire. Tragically, Mr. Kronemeyer lost his life in this accident. The Florida Highway Patrol will investigate the accident. 14 Year Old (Christopher Cededa) Hit By a Car Crossing U.S. 27 - Teen Was Distracted by Mobile Phone (Text Messaging)

Christopher Cepeda, a 14 year old from Davenport, Florida, was the unfortunate victim of a car accident recently. The accident took place at approximately 8:00 p.m. just South of the intersection of U.S. 17 and Legacy Park Boulevard. Christopher was with three friends at the time. News report indicate that the three friends saw the 1998 Buick Sedan driven by Denise Sottilaro but Christopher did not because Christopher was looking down at his mobile phone at the time. Christopher suffered serious personal injuries and was taken to Arnold Palmer Hospital in Orlando, Florida where he died from his injuries.

This accident shows the importance of safety when using mobile phones. It is clear that the use of mobile phones by pedestrians, bicyclists, and drivers is distracting. It should also be noted that Florida is a comparative fault state. In other words, a jury or judge could determine that more than one party was at fault for the accident. Woman (Rita Willis) Dies and Child (Chloe Castro) Seriously Injured in Flagler County, Florida Crash Near Bunnell

The Florida Highway Patrol has reported that a 60 year old woman (Rita Willis) died and a 4 year old child (Chloe Castro) was seriously injured in a Flagler County, Florida crash near Bunnell. The accident took place as Ms. Willis attempted to make a left hand turn from Canal Street to County Road 305. Ms. Willis was not wearing a seat belt. The force of the crash threw Willis into the back seat on top of Chloe. The child was taken to Halifax Hospital in Daytona Beach where she was listed in critical condition.

Under Florida law, a person making a left hand turn has a duty to yield the right of way to oncoming traffic. Of course, there are exceptions to this general rule when there is a green arrow or other circumstances in place. Since there was a death involved in this crash, the Florida Highway Patrol will conduct a thorough accident investigation to determine the cause and manner of the crash.

Another Tragic Back Over Accident Causing a Child's Death in Jacksonville Florida

In Jacksonville, Florida, a 2 year old girl was tragically killed when she was accidentally run over by the family SUV according to the Jacksonville Sheriff's Office. Apparently, the two year old ran away from her mother's side as the father was backing up the SUV. The mother attempted to reach over for the child but could not reach her in time. The child was taken to Shands Hospital Jacksonville where was pronounced dead. Unfortunately, this death is not an isolated event since back over deaths take place every year throughout the United States.

Flagler County Man (Desmond Raenell Grimes) Dies in Ford Bronco Rollover Accident

A Flagler County man (Desmond Raenell Grimes) died Monday when he was pinned in a ditch by an overturned Ford Bronco. There were also two teens (Brad English and Corey Lalomia) in the vehicle who suffered minor injuries as a result of the roll over crash. News reports indicate that none of the occupants had a seat belt on at the time of the crash.

Florida law does require occupants to wear a seat belt. In a personal injury case, the use or non use of a seat belt is only relevant if it can be proven that the use of the seat belt would have likely prevented injuries or would have resulted in less serious injuries than sustained.

Semi Tractor Trailer Decapitates Pedestrian in Orlando, Florida

In Orlando, Florida, a brutal accident took place involving a pedestrian, Nissan Altima, and a semi tractor trailer. A pedestrian was walking across the street when the driver a a Nissan struck the pedestrian. Thereafter, the driver of the Nissan pulled over to check on the pedestrian when a driver of semi tractor decapitated the pedestrian and kept on driving. It was certainly a brutal and unsightly incident. The Florida Highway Patrol shut down the area at West Colonial Driver and Hiawassee Road for three hours to investigate. Investigators will attempt to identify the pedestrian victim with fingerprints. If anybody has any information regarding this accident, the FHP should be contacted. Hopefully, the semi tractor trailer driver can be identified and interviewed in order to find out more about this tragic accident.

Teen Driver Accidentally Strikes 3 Year Old Nephew in Jacksonville Florida

A tragic accident recently took place in Jacksonville, Florida. A teen driver was moving the family car after a church service and accidentally hit his 3 year old nephew. The incident happened at approximately 1:15 p.m. in the afternoon. The teen reported that the driver's seat to the Dodge Intrepid broke as he was driving the vehicle. As a result of the seat breaking, the teen lost control of the vehicle and struck the 3 year old nephew. The 3 year old boy was taken to Shands Jacksonville with life threatening injuries. The incident took place in front of Summerville Baptist Church, near downtown Jacksonville, Florida.

The vehicle should be inspected by law enforcement to determine if the driver's seat caused or contributed to the accident. There are many factors that should be part of the investigation as to the seat:

What was the year of the vehicle?
Were there prior problems with the seat in the past for this vehicle?
Were there prior problems with the seat for Dodge Intrepids in the past?
Has there been any manufacturer recalls for the seat or any of the parts?
Was the seat probably positioned prior to the accident?
Is there a design defect as to the seat?

Dangers of Teen Drinking and Driving

Teens these days can be quite advanced in what they know and what they do. However, many teens, while loaded with knowledge, often lack good judgment. This especially applies to drinking and driving. It is well know that alcohol impairs judgment and motor skills. When you combine impaired judgment with poor judgment to begin with, you have a most dangerous combination. Because of this, there are alarming statistics out there on teen drinking and driving. Prevention and education are key to making the streets safer for our children. Teens often drive under the influence because they believe that they are invincible. They also drive and do not ask for help for fear of punishment or retribution by parents. While parents should not encourage or accept a teen who drinks alcohol, parents at time need to let their children know that safety is paramount to everything else. If your teen or a friend of your teen needs a ride or assistance, make sure that your child knows that you will be there day or night for a ride. It is far preferable to pick up your child from a party or a friend's house late at night than an emergency room or morgue / medical examiner's office later. Florida Bicycle Laws - Rules of the Road and Sidewalk

In Florida, there are specific laws in place as to the safe operation of bicycles. Many of these laws mention the role of motorists and pedestrians as well. The Florida Bicycle Association has as good web site that contains a summary of the relevant Florida Statutes as well as many safety tips for bicyclists, pedestrians, and drivers. In Florida, children are frequently injured while riding a bicycle when a driver fails to notice the bicyclist, drives too fast for road conditions, and fails to yield the right of way to bicyclist. While children should and do know basic bicycle safety, it is up to drivers to take extra steps when children on on or near roadways on their bicycles. I recommend that you educate yourself on the bicycle laws for the State of Florida. Whether you are a bicyclist or not, it is important to know these rules of the road and sidewalk. Miami Driver With Terrible Driving Record Charged with DUI that Killed 3 Children

Gabriel Delrisco caused an accident that killed three children. Delrisco was arrested for DUI after he was released from a hospital. His blood alcohol level was .239 which is approximately three times the legal limit. Mr. Delrisco's driving record was terrible. It has been reported that he had 26 previous driving citations and one prior DUI in 2001. A judge held Mr. Delrisco without bond until trial when the judge determined that Mr. Delrisco was a danger to the community. Mr. Delrisco rearended a vehicle occupied by the Serrano family that was stopped a red light. A candlelight ceremony was recently held in Homestead, Florida for the Serrano family. The family deserves the support of the community. It is certainly a tragedy that the Serrano family is mourning the death of three children who died as a result of the careless, reckless acts of a drunk driver. Small Plane Hits Vehicle and Kills Two People Near Private Tallahassee (Leon County) Runway

A tragic accident recently took place in Leon County, Tallahassee, Florida. A small private plane was taking off from a private runway when it crashed into a Jeep vehicle that was driving alongside the single engine plane. After the Jeep was struck by the aircraft / airplane, the Jeep crashed into a tree. There were two people in the Jeep who died as a result of the crash. The Federal Aviation Administration (FAA) will conduct an investigation into this crash. Authorities and investigators will evaluate various issues including but not limited to the following:

What was the layout and size of the runway?
Did the pilot have a license?
What training did the pilot have?
How far was the Jeep from the airplane prior to the crash?
Were there any mechanical defects or problems with the airplane or the Jeep?
Were drugs or alcohol involved by the driver or the pilot?
What safety precautions were taken by the pilot to avoid the accident / crash?

Two Dead Following Baker County Automobile Accident

Two men died as a result of a Baker County, Florida accident on State Road 121 about 2 miles South of Interstate 10. A Pontiac occupies by Charles Sharp, age 21, and David Moody, age 31, crossed over the center line and struck the left side of a Toyota pick up truck driven by Arthur Hewett.

The Florida Highway Patrol responded to the incident and will conduct a homicide investigation as to the cause of the accident and the identity of the driver of the Pontiac.

Tampa School Bus Driver (Linden Brown) Rear Ends Vehicle Stopped for Emergency Rescue Vehicle

A school bus driver from Pinellas County, Florida rear ended a vehicle properly stopped for an emergency rescue vehicle. Bus driver, Linden Brown, was issued a traffic citation for the crash. Two students from Bay Pointe Elementary School were taken to a local hospital for medical treatment following the school bus / automobile accident.

This accident shows the importance of pulling over for emergency rescue vehicles. All drivers including school bus drivers have a duty to obey these rules of the road. Westside Jacksonville Florida Pedestrian Hit and Killed

A pedestrian was hit by a vehicle on Hershel Street in Jacksonville, Florida. The Jacksonville Sheriff's Office are investigating the incident but do not believe, at this time, that the driver was at fault. Drivers have a duty to yield to bicyclist and pedestrians but there are instances when an negligent bicyclist or pedestrian makes an accident unavoidable. Florida Law - Who Is Responsible for Compensation for Injuries and Damages for a Rear End Crash / Collision) ?

In Jacksonville, Florida and other Florida cities, there are rear end crashes / collisions every day. In these automobile accidents, the police officer will typically issue the traffic citation to the driver who rear ended the other driver. Pursuant to Section 316.0895, Florida Statutes - Following Too Closely, Florida law mandates that the driver of a motor vehicle shall not follow too closely to another motor vehicle than is reasonable and prudent. If there is a crash, the police officer and judge for that matter will presume that the driver who rear ended the other driver is at fault unless there is some compelling reasons to make a different conclusion. It is important for a driver to maintain a safe distance so that the driver can bring his or her vehicle to a stop in case traffic ahead stops or slows for traffic or other road conditions.

Inattentive and careless drivers cause rear end accidents that result in serious personal injuries and related medical bills and lost wages for victims of these accidents. Driving slower at a safe distance could have avoided many of these accidents. Buckman Bridge Crash - Leaves 1 Dead and 3 Injured - Use of Emergency Lane - Death Investigation

A crash on the Buckman Bridge in Jacksonville / Orange Park, Florida has left one man dead and three injured according to the Florida Highway Patrol. The FHP reports that Jhony Nunez-Serrano was stopped hearing Northbound in the emergency lane at about 3:45 a.m. Another man, John Dame Robinson, of Green Cove Springs, crashed into the Nunez-Serrano vehicle. As a result of the crash, Mr. Nunez-Serrano died and three others were injured. The Florida Highway Patrol will complete a death investigation into this matter to determine the causes and contributing causes for the crash. Mr. Nunez-Serrano reportedly had mechanical problems with his vehicle and pulled into the emergency lane. It is uncertain and unknown at this time why James Dame Robinson was in the emergency lane. It is also certain if Jhady Nunez-Serrano put his caution / flashing lights on when he pulled over.

Toxicology testing will be completed for each driver to determine if drugs or alcohol played any role in this accident. In Florida, automobile accident cases are subject to comparative fault negligence laws. In other words, a jury can apportion fault between two or more people or Defendants if the jury determines more than one party was at fault. The Florida Highway Patrol report is important but is not binding for a civil case by an injured party. 6 Year Old Gainesville, Florida Girl (Jani'yah Irving) Run Over By Semi Truck in No Through Route for Trucks

In Gainesville, Florida, a 6 year old girl (Jani'yah Irving) was run over by a semi truck on Northwest 12th Terrace and Northwest 32 Avenue. Jani'yah was riding her bicycle with a friend. Jani'yah had problems stopping at an intersection / stop sign and rode her bicycle under the large semi truck driven by Marcus Olden, Jr. Tragically, Jani'yah was run over by the rear wheels of the truck. While Jani'yah may not have been wearing a bicycle helmet, it does not appear that this would have made any difference with respect to the fatal injuries suffered by Jani'yah.

The Gainesville Police Department and / or the Florida Highway Patrol will conduct an investigation into the death of Jani'yah Irving. In conducting the investigation of this accident, investigators may consider the following factors:

What was the speed limit in the area?
What was the estimated speed of the truck driver?
What was the estimated speed of Jani'yah?
Were the street signs in the area (No Through Trucks, Stop Sign) clearly visible?
Why did the truck driver drive into an area with the No Through Trucks sign?
What other routes were available to the truck driver?

Four Year Old Christopher Robles Died After Being Struck by Van in Front of Hartsfield Elementary School in Leon County (Tallahassee) Florida

Four-year-old Christopher Robles died Friday after he was struck by a van in the street in front of Hartsfield Elementary School in Leon County (Tallahassee) Florida. Christopher got out of his mother's Jeep Cherokee and then ran into the street according to news reports. Christopher was hit as he was crossing the street by a teacher (Cynthia Roy) who was driving a Chevorlet Van. Christopher did not use the crosswalk. According to Tallahassee Police Department Officer David McCranie - the child appeared to have darted out in front of traffic. Officer McCranie noted that speed or alcohol did not appear to have any part in this accident. It is a sad and tragic event for both the Robles Family and the Roy Family. It is interesting to note that teachers face challenges everyday in the classroom. In addition, teachers have to drive into a school zone every day as part of work. School zones are loaded with children like Christopher Robles and it can be a challenge each day for a teacher to pull his or her vehicle safely into a parking lot while making sure to watch out for children, teachers, and parents.

In Florida, a 4 year old child cannot be held negligent for his or her own actions. A parent can be held negligent for negligent supervision. Other drivers can also be held negligent as well. Florida has a concept called comparative negligence. In other words, a jury could ultimately determine that more than one person was at fault or negligent for an incident taking place. It should also be noted that under Florida law an investigating police officer does no get to be judge and jury for the cause of an accident in a civil case. Unless the police officer actually witnessed the incident, the police officer can be precluded with proper motion and argument from giving an opinion as to who the police officer believed was at fault or the cause of an accident.

Further investigation of the death of Christopher Robles will be completed by the Tallahassee Police Department and the Florida Highway Patrol.

6 Month Old Jayla Lee Killed in Central Florida Car Crash

Running a red light is a traffic violation. It can also lead to the death of innocent victims like Jayla Lee who was killed in a traffic accident that took place in Lake Wales, Florida. Mitchell Andrew Hilkemeyer ran a red light and crashed into the 1999 Chevrolet driven by Nicole Pounds and her passengers which included Jayla Lee. Jayla was seated in a child safety seat at the time of the crash. The Florida Highway Patrol reported that Jayla died at the scene.

It is a tragedy that a child dies and others sustained serious personal injuries when a driver runs a red light. Three Injured in Police Chase of Stolen Vehicle in Daytona Beach, Florida

Three people were injured as a result of the theft and careless driving of a SUV in Daytona Beach, Florida. Officers with the Daytona Beach Police Department chased a criminal suspect (Michael Henry - age 21) through the streets of Daytona Beach as he sped across George W. Engram Boulevard. Several vehicles were damaged in the chase. Three people were injured with some of the accident victims being treated at Halifax Health Medical Center in Daytona Beach, Florida. Injury victims were identified as Atanasije Conic (age - 83), Saresa Taylor (age - 34), Kenneth Davis (age - 35), and Dontaiavaw Taylor (age - 11 months).

Syntyche Jacques (7 Year Old) and Other Family Members Injured in Serious Automobile Accident in Martin County, Florida

An automobile accident resulting in serious and life threatening personal injuries recently took place in Martin County, Florida according to a report in the Treasure Coast Palm Beach Newspaper / Website at Hit and Run Driver Claims that He Fell Asleep at the Wheel in Martin County, Florida.

The accident involved serious injuries to the Jacques family which included the Jacques children: Carlos Jacques, Moise Jacques, Ricky Jacques, Luke Jacques, and Syntyche Jacques who were taken emergently to St. Mary's Medical Center in West Palm Beach, Florida.

The at fault driver, Jaime Jaramillo, fled the scene. He later reported that he fell asleep while driving. Mr. Jaramillo was arrested for leaving the scene of an accident with injuries. He was tracked down by a helicopter patrol and a K-9 unit.

The accident happened at 4:30 a.m. This story shows the importance of safe driving no matter the time of day, night or morning. Mr. Jaramillo should have stayed off the road if he was tired or pulled over to get some rest. His negligence will have a lifetime effect on the Jacques family and others injured in this automobile accident.

Pick Up Truck Crashes into a Pond - Maplewood Elementary School Teacher Dies - Florida Highway Patrol Seeks Help with Investigation

A Maplewood Elementary School teacher (Marion County) drowned after the teacher and her family were driven off the road by an unidentified driver. The second grade teacher - Carrie Hammer - of Ocklawaha, Florida was trying to get equipment from the vehicle that was in the pond for her son who has cerebral palsy. Her son was having some breathing problems due to being in the water. The equipment was needed to help suction her son. It is apparent from this tragic story that Carrie was a dedicated mother who put family first above all else in her life.

Another vehicle drove into the right of way of her husband, Sean Hammer, who was driving a truck. Mr. Hammer steered the truck off the road and into a pond to avoid a collision.

Carrie Hammer was later pronounced dead at the Munroe Regional Medical Center in Marion County, Florida. The Florida Highway Patrol is seeking assistance to help find the other driver who was in a white pick up truck or SUV. The other driver appears to be the cause of the accident. In addition, the other driver did not stop to render any help to this family who certainly was in need of assistance. Marion County lost a very caring Special Education teacher. More importantly, the Hammer family lost a mother and wife to a tragedy that was caused by the negligence of another driver. Nothing can be done at this time to bring Carrie Hammer back but it would be nice to see justice done by locating the driver responsible for this tragedy. Loss of Companionship of Child (Filial Consortium in Florida)

The parent of a Florida child can pursue a claim for pain, suffering, and loss of enjoyment of life on behalf of the child when a child is seriously injured. What about the parents injuries, losses, and damages? Can a parent collect for the loss of companionship of the child when the child is seriously injured but does not die as a result of the injuries. The answer in Florida is "Yes". The loss of companionship in Florida to a parent of an injured child is called "Filial Consortium". The logical follow up question is as follows: What period of time can a jury award the loss of Filial Consortium to a parent? The answer is "until the child reaches the age of majority" which is 18 in the State of Florida. This very issue was addressed in a Supreme Court of Florida case. In a case against the Broward County School Board, the Supreme Court determined that the damages to a parent for the loss of Filial Consortium (companionship to the parent from the child) can be awarded for a time period from the injury to the child's 18th birthday. As such, if a 15 year old was seriously injured but did not die, parents can pursue a claim for themselves for the loss of Filial Consortium from the age of 15 to 18 or roughly 3 years. Dangers of the Road Involve Running Stop Signs and Failing to Wear Seat Belts - Two Die in Crash with Lynx (Orlando, Florida) City Bus

In Orlando, Florida, two men died when a car driven by Alester Martinez ran a stop sign and crashed into a Lynx (Orlando, Florida) Bus. Mr. Martinez was injured in the accident but survived. His two passengers, who were not wearing seat belts, died as a result of the crash. Two of the bus passengers were also injured.

Stop Signs serve a basic but very important function of directing traffic and giving one street the right of way. It is the duty of every driver to stop at a stop sign, look carefully for traffic, and only proceed when traffic is clear and safe to do so. Palm Coast Teen (Samantha Schleh) Dies While Trying to Help Injured Dog in Roadway

A Palm Coast, Florida teen, Samantha Schleh, age 19, died while standing on State Road A1A. Samantha and her friend, Michael Griffin, were trying to direct traffic and vehicles away from a dog that had been hit by a car. From news reports, it is difficult to determine if the incident was avoided or not. What was the lighting in the area? What was the speed limit in the area? What were road conditions? What were traffic conditions? How did the dog get hit to begin with? Was the dog a stray or owned by somebody? It is most unfortunate that a young woman (Samantha Schleh) lost her life especially while she was trying to do a good deed. The Florida Highway Patrol will evaluate the incident and prepare a homicide report as to the contributing factors and causes of the death of Samantha Schleh. Bicyclist Critically Injured After Being Hit by a Car in Jacksonville, Florida (Blanding Boulevard - Westside)

Jacksonville, Florida is the biggest city (land mass) in the country. Like other large metropolitan areas, Jacksonville has some busy streets. Blanding Boulevard is a major street that runs through two counties (Duval and Clay). A bicyclist was critically injured when he was hit by a car at approximately 10:00 p.m. in the evening. Police reported that it did not appear that driver's negligence played a role in the accident. Sergeant Knox of the Jacksonville Sheriff's Office completed the investigation of the accident. Sergeant Knox's assessment of the accident may be completely accurate and complex. However, many people do not know that the investigating officer can make a decision as to citations but has no power to make a decision as to civil liability or insurance coverage. In most cases, the police accurately assess an accident. As such, insurance companies are apt to follow the analysis and assessment of the police officer. Bicyclist Death in St. Augustine Involving Delivery Truck - Investigation and Cause of Accident

A German tourist, Karla Koehler, was struck by a delivery truck in St. Augustine, Florida. The accident took place at the intersection of San Marco Drive and Bernard Street. Tragically, she died as a result of the accident. Her husband was riding his bicycle behind her at the time of the accident. The St. Augustine Police Department will investigate this accident as to cause, contributing factor, and right of way.

St. Augustine is filled with pedestrians and bicyclist on a daily basis. I have visited St. Augustine many times both during the week and on weekends. Some streets and sidewalks are narrow and vehicles must drive slow to account for the foot and bicycle traffic. Caution and awareness on the part of both drives and bicyclists can help avoid accidents involving injury and death.

Mrs. Koehler was killed on impact. It is certainly a tragedy whether a tourist or a local resident is killed in an trucking accident / bicycle accident.

The St. Augustine Police Department or another police agency will ultimately issue a homicide report. Assistance may come from the St. Johns County Sheriff's Office and / or the Florida Highway Patrol in conducting this investigation. Whatever the results of the investigation of this nature, the victim's family has the ability to hire a private attorney and accident reconstruction expert to conduct its own investigation as to the cause of such an accident.

New Ford Vehicles Will Allow Parents to Control Teen Driving

Ford is promoting an option on 2010 models that will allow parents to control vehicles using a computer chip in the key. Parents will be allowed to better control speed (down to 80 miles per hour), seat belt usage, and music volume when teens or other drivers are using the vehicle. Hopefully, technology like this will help prevent or reduce automobile accidents and trucking accidents in Jacksonville, Florida and other cities throughout the United States. Taking from experience as a parent and a Florida personal injury lawyer / attorney, I would expect that many parents will take advantage of this technology. Teens will not like the control and will ask the parents to "trust me" and "don't worry". GPS technology is already in place at this time. I predict that future models will be available to the general public that will allow parents to monitor teen driving like employees do. There will be a tradeoff between the teen's privacy concerns and the parents need to know and their concern for the safety of the teen. Like most parents, when my child starts driving, I want to know if the child is driving 100 miles per hour or going to places where the child does not belong is or is not permitted to go to. Unfortunately, it is a scary world out there and parents should be concerned for the safety of their teen children who get behind of the wheel of a vehicle. AAA (American Automobile Association) recently posted some valuable tips for safeguarding / child proofing vehicles. In 2006, three to four children were killed each day and more than 500 injured each day in automobile accidents. The safety tips suggested by AAA included the following:

*Secure loose items;
*Use child locks;
*Use correct safety restraint and seat belts;
*Install the child seat securely and correctly;
*Position small children away from airbags;
*Use or store only soft toys in the vehicle;

Dangers of Semi Tractor Trailers - Husband and Wife (Blanch Whiddon and Brandon Whiddon) Die After Crash

Blanch Whiddon and James Whiddon were the unfortunate victims of a trucking accident that took place on New Kings Road near Moncrief Road in Jacksonville, Florida. Witnesses reported that the semi tractor trailer failed to obey the traffic signal and violated the Whiddon's right of way. Wife dies after wreck that killed husband in Jacksonville, Florida.

Trucking accidents can be avoided with slower speeds, better attention, and compliance with the rules of the road and traffic signals.

One major problems with roadways in Jacksonville, Florida and the rest of the United States is the disparity in size between vehicles on the road way. Pedestrian and crossing safety are very important concepts to teach small children. We, as parents, do our best to tell our children to stay out of the street, look both ways when crossing, and to hold our hands when crossing the street. Palm Coast Couple - Victims of Road Rage - Man Shot By Fleeing Truck Driver

A 69 year old driver and his 68 year old wife were the victims of an act of road rage recently. The driver sustained a bullet injury to his arm and was taken to Baptist Medical Center South in Jacksonville, Florida for treatment. The couple noticed the pick up truck was tailgating them prior to the shooting. Apparently, the driver of the pick up truck was angry with the couple and took his "road rage" out on them by shooting at them. We do not live in a world of Grand Theft Auto which is a popular video game where the driver runs over people and shoot them. Unfortunately, there is little information available for the suspect as the couple did not obtain the suspect's tag number or even the State where the truck was from.

Road rage incidents like these are hard to prevent and predict. Since we cannot predict the intentional or negligent actions of other drivers and many at fault driver will flee the scene, it is advisable to have Uninsured Motorist insurance in place to have that added insurance coverage for injuries, medical bills, and pain and suffering caused by an uninsured, underinsured, or phantom / fleeing driver / vehicle. Text Messaging Can Kill Your Child - Dangers of Text Messaging While Crossing Streets

In Davenport, Florida, Christopher Cededa, a 14 year old died, after being hit by a vehicle while text messaging on his cell phone. His friends saw the 1994 Buick and stopped. Christopher was busy sending a text to somebody and did not notice the vehicle. The Polk County Sheriff's Office stated that the woman driver probably would not be charged with any violation or traffic citation.

Technology is great but it can cause distractions for pedestrians, bicycle riders and drivers. Just like drinking and driving does not mix. Texting and walking close to roads or across roads does not mix. Christopher's death is tragic for his family and the community. Frances Margay Schee, 13, a North Marion Middle School student, died shortly after 4 p.m. as a result of a rear end crash caused by a Tractor Trailer that may have some connection with CSX Railroad, a large corporation based in Jacksonville, Florida. It is interesting to note the CSX web site states that its vision is "to be the safest, most progressive North American Railroad, relentless pursuit of customer and employee excellence." If CSX had some role or responsibility regarding this accident, CSX certainly fell well short of the vision.

Nine people were taken to the hospital and two students were reported to have critical injuries. Witnesses to the incident noted that the semi tractor trailer never stopped prior to the crash. Apparently, the school bus was stopped on a clear day. The impact shoved the large yellow school bus 275 feet. A few minutes later, a series of explosions started. Motorcyclist (Rick W. Roupp) Sustains Critical Injuries in Accident with 20 Year Old Driver (Tabbatha Roux) in St. Augustine, Florida

In St. Augustine, Florida, a 46 year old motorcyclist - Rick W. Roupp - sustained critical injuries when a vehicle driven by 20 year old Tabbatha Roux attempted a left hand turn into the right of way of the motorcyclist. The motorcyclist was not wearing a helmet. Nassau Teens Die in Car Crash (Kaleb Whitemore and Diane Lee Mumford)

Two Nassau County, Florida teens died on Sunday going home from Sunday Services at the First Baptist Church. Kaleb Whitemore was driving home with Diane Lee Mumford as a passenger. For unknown reasons according to the Florida Highway Patrol, the Ford pick up truck skidded off the road, overturned three times, and then ejected both teens from the vehicle. Unfortunately, neither Kaleb or Diane were wearing seat belts. Kaleb and Diane were transported to Shands Jacksonville Hospital where they died.

Diane Mumford was a junior at West Nassau High while Kaleb Whitemore was homeschooled and previously attended West Nassau High.

Further investigation will be completed by Florida Highway Patrol to determine the cause and manner the accident. The family may also wish to retain a private accident reconstruction expert and / or a Florida personal injury attorney / lawyer to try to get some answers as to this tragedy.

North Florida Child (Nylah Sakira Dickerson) Accidentally Run Over by Family Member (Yulee Florida)

Nylah Sakira Dickerson, age 1, was accidentally run over by a family member when Nylah was in the driveway at a home in Yulee (Nassau County) Florida. The incident was witnessed by Nylah's grandfather who attemoted to get the attention of the driver. Nylah was taken to Shands Jacksonville Hospital where she was pronounced dead. Is a Shooting that Causes Injuries or Death Covered Under Automobile Insurance in Florida?

Unfortunately, Jacksonville, Florida and other cities in Florida are the site of serious injuries and deaths as a result of drive by shootings and other shootings. Two Teens Airlifted to Shands Jacksonville after Baker County Accident

Two teenagers were airlifted to Shands Jacksonville following an accident that took place on August 19. Driver Bradley Meister (Age 17) and passenger Ashley Curry (Age 17) were injured when Bradley Meister overcorrected his driving after running of the right shoulder of the roadway on Woodlawn Road. Both teens were airlifted to Shands. The other vehicle involved in the crash was driven by Kathy McDonals (Age 40). Ms. McDonals suffered minor injuries. Trooper D.L. Myers of the Florida Highway Patrol reported the facts regarding the crash. The story was reported in the Baker County Press - Two Airlifted to Shands.
