Snake Bite Sends Florida Teen to the Hospital

Florida has its fair share of wildlife including snakes. Weather changes and construction often times bring snakes out of the hidden and on the move. A high school basketball player was bit when he went to get a ball that had rolled into the bushes. The pygmy rattlesnake bit Jonathan Yokel, age 16, on his hand. He was later treated at a Tampa hospital. Snake bites are painful and, at times, can be fatal. Jonathan was given 14 vials of antivenin and other medications at the hospital. Cybercrimes, Child Predators and Sex Offenders Are Out There. Take Measures to Protect Your Children

Years ago, parents could protect their children from child predators by locking their doors and windows. A child predator could not get into a securely locked home. With technology and the internet, times have changed. Now, child predators and sex offenders now try to contact and lure our children through the internet. In addition to door and window locks, parents should take safety and security measures to make sure that child predators do not contact our children online via e mail, text messaging, social networking sites, gaming sites, and other internet avenues.

The Florida Attorney General Cybercrime website has great resources and information to educate parents and guardians against insidious criminals who creep around the internet looking for victims. It is difficult to keep up with technology and children often times know more than their parents about the computer and internet. Since criminals are educating themselves about the internet, parents should also educate themselves. Fernandina Beach, Florida Five Year Old Dies After Tragic Boating Accident

A tragic boating accident in Lake George (Florida) ended the life of a Fernandina Beach 5 year old and other children as well. Cole Bizuk, from Fernandina Beach, Florida died when a boat he was in capsized in Lake George. Cole was one of the victims who trapped in the cabin of the boat when it capsized. It was reported that all of the children on the boat except one were wearing a life jacket. Unfortunately, a life jacket was not sufficient to save Cole and others who were trapped in the cabin of the boat.

Two Florida Children Die When Boat Capsizes in Lake George

Florida summers bring with it swimming and boating activities. Florida summers also bring stories of tragedies and deaths that take place in Florida swimming pools, lakes, rivers, canals, and oceans. In Ocala, Florida two children died after a boat capsized in Lake George. A storm produced waves three to four feet high that, in turn, capsized the boat. Dennis Clayton Lennon, age 4 of Umatilla, Florida, and Ciara Puskas, age 14 of Eustis, Florida died when they were trapped in the cabin of the capsized boat.

When boating or planning a boating outing, a responsible adult should pay close attention to weather reports and plan accordingly. Of course, many incidents are tragedies that could not be predicted or prevented. Others tragedies including serious personal injuries and deaths to Florida children result from poor planning, improper equipment, and the failure to use life jackets and other safety measures.

Imam at Tampa Mosque Charged with Sexual Battery of 13 Year Old Boy

In Tampa, Florida, a Imam has been charged with sexual battery on a child. A 13 year old boy accused the religious leader of the attack and molestation. Police interviewed the boy and his family at Tampa General Hospital and thereafter arrested Yasser Mohmed Shahade for the alleged crime. The Imam will be entitled to the services of a public defender or, in the alternative, can hire a private attorney to defend him in this action. Initial news reports did not contain the details or the evidence involved with this crime. It would be interesting to find out the following details:

Were there any other witnesses to the incident?

How exactly did the Imam sexually assault or attack the 13 year old boy?

Did the Imam commit any similar acts in the past?

Were there any video cameras or surveillance cameras at the mosque that would either help defend the Imam or lend support to the boy's allegations?

What forensic evidence exist as to the alleged assault?

What type of physical examination was performed at the hospital? What were the findings?

Is the mosque going to perform its own investigation as to these actions?

What is the position or explanation of the Imam as to the allegations made by the boy?

These and other issues would be important know in considering the strengths and weaknesses of each party to this matter. While the acts of one religious leader do not speak for the acts of all, the allegations involved with this story are serious and should be fully investigated. Woman Turns in Husband and Father in Law for Possession of Child Pornography on Computer in Auburndale, Florida

Child pornography crimes are sometimes committed by members of the same household. In Auburndale, Florida, a woman (Dani Stump) turned in her husband (Roger Stump) and her father in law (Wesley Stump) for possession of child pornography. Dani found child pornography photos and videos on the family computer. Dani contacted the Polk County Sheriff's Office who later seized the computer and arrested the men. Both men were registered sex offenders from prior criminal acts. Dani Stump was faced with a difficult decision in turning in family members. Mrs. Stump chose the safety of children and decency over any family ties in making this important decision. Florida - Most Dangerous State for Bicyclists - Personal Injuries and Wrongful Deaths on Florida Roads

Florida has the highest number of fatalities of bicyclists compared with other States. According to the National Highway Traffic Safety Administration, there were 113 bicyclists who died in Florida in 2008 and 121 bicyclists who died in 2007. These figures are quite disturbing when evaluating the numbers for Georgia, the state adjacent to Florida, had 16 deaths in 2007 and California, which is a larger and more populated state, had 109 deaths in 2007.

Florida drivers should take due care when driving near bicycle paths and bicyclists. This is especially true for child bicyclists.

Twin 2 Years Olds Drown in Pond in Northside of Jacksonville, Florida

On the Northside of Jacksonville, Florida, twin girls recently died as a result of a drowning incident. The girls lived in a home near a retention pond and wandered into the pond where they both drowned. CPR was attempted on the girls to no avail. The girls were later pronounced dead at Shands Jacksonville Hospital.

This story shows the importance of supervision and barriers / fencing for homes near bodies of water including but not limited to retention ponds. Unfortunately, children do not understand or appreciate the dangers of water. Furthermore, children lack the judgment regarding their swimming abilities and the depth of waterways.

2 Year Old Toddler Survives Shooting in Keystone Heights, Florida

In Keystone Heights, Florida, a 2 year old toddler Conner Keene) was recently shot in the stomach while a a home in the area. The Clay County Sheriff's Office officials believe that the shooting was accidental. Detectives, however, do not believe that Connor fire the gun which was a .22 caliber handgun. Conner underwent surgery at Shands - University of Florida. The child is expected to recover from these injuries. Clay County Sheriff's Office detectives will further investigate this matter to determine if any criminal charges would be filed. Issues or questions that may be addressed through the investigation may include the following:

Who is the registered owner of the gun?

Were there any safety precautions in place to keep the gun away from children?

Who fired the gun?

What did witnesses report as to the incident?

Who owned the home where the incident took place?

Is there homeowner's insurance coverage in place to cover the medical bills?

What adults, if any, were supervising the child and other children at the time of the incident?

Mother Whose Child Drowned in Bathtub Faced Criminal Charges in Volusia County Florida

A Volusia County mother (Crystal Giachetti) is being charged with aggravated manslaughter for the drowning death of her son, Trenton Giachetti, who died on April 6. The medical examiner had previously determined that the death of the baby was an accident. Witnesses heard Crystal Giachetti comment prior to the death of her child that she "felt like putting the baby in the tub, turning on the water and leaving". Apparently, Crystal Giachetti had left in baby in the tub on prior occasions. Finally on April 6 - the baby, while left unattended in the tub, drowned and died. Crystal Giachetti will be entitled to a public defender or, in the alternative, can hire a private criminal defense attorney. I suspect that the defense will be that the chid died as a result of an accidental drowning and that there was nothing intentional on the part of the mother as to the child's drowning death. Whether the child died from simple negligence or criminal neglect or intentional acts, a child's life is lost as a result of a mother who failed this child. Former Florida Official Gets Prison Term of 24 Years for Child Pornography

A former official with the Florida Department of Children and Families has been sentenced to 24 years in prison for child pornography. Al Zimmerman formerly worked for the agency that was charged or responsible for protecting Florida children. In fact, Mr. Zimmerman was the spokesperson for this agency. It is truly sad that a man put in this position of trust and responsibility would be accused, arrested, and convicted of child pornography charges for having and paying for nude photographs of boys. One of the boys was even under the care of the Department of Children and Families. Mr. Zimmerman pleaded guilty to these charges. Mr. Zimmerman was hired into the wrong position. His arrest and conviction truly was a public relations nightmare for the Department of Children and Families. Four Middle School Students Face Felony Charges After Sexual Assault of 13 Year Old Boy

Hazing and sexual assaults continue to take place in schools across the nation including in Tampa, Florida. Recently, four middle school students were accused of felony assault charges. A 13 year old boy has accused these middle school students of assaulting him with a broomstick and a hockey stick. Why middle school students would deem this to be sport or proper treatment of another person is beyond comprehension? There is no mistaking the hazing, assaulting, or abuse for anything else. These acts, if true, are criminal and should be punished through a criminal conviction and prison time even if the perpetrators were middle school students. Boys Taken from Levy County Playground Safely Returned - Police Investigation for Man in Red and White Pick Up Truck

In Levy County (Williston), Florida, two 1st graders were taken from a Levy County (Williston) playground recently. A man in a red and white pick up truck took the children into his truck, drove 100 yards, and the children got out on the side of the road. The Joyce M. Bullock Elementary School was placed on lock down following the incident according to the Levy County Sheriff's Office. The boys later reported that they did not know the man in the pick up truck. Fortunately, the boys were returned; however, it is quite frightening for the children, parents, and community that this incident took place that similar incidents could take place in the future in Levy County and other counties in Florida. Florida Boy Scout Dies on 7.7 Mile Hike

In Naples, Florida, officials have reported that a 17 year old boy scout (Michael Abelman) died while on a hike in the Big Cypress National Preserve. Collier County, Florida Sheriff's Office reported that the death may have been related or caused by a medical problem. Due to the age and circumstances of the death, I suspect that an autopsy will be performed to determine cause and manner of death. It is certainly tragic that Michael Abelman died at such a young age. Typically, young men who remain in the boy scouts through their late teens are dedicated individuals with a bright future ahead of them. Greek Orthodox Archdiosese Settles Jacksonville, Florida Sexual Assault Lawsuit

In Jacksonville, Florida and other cities, churches should be a safe haven for children. A place that children can learn, grow, and pray in safety and comfort. Churches should not be the site of sexual abuse and assaults, but, unfortunately, over the years, many churches have been the site of unspoken horrors and disturbing incidents. The Greek Orthodox Archdiocese recently settled a lawsuit for a confidential amount. The lawsuit was brought by a man, who is now 23 years old, and his family. The Very Rev. Nicholas T. Graff was accused of sexual assault. Graff was so infatuated with the boy that he even offered to adopt the child. Many years later, Graff was suspended from all of his church duties. The church was sued due to its alleged negligent assignment and supervision of Graff who was subject to prior abuse allgations. Many child injuries and deaths resulting from automobile accidents involving bicyclist and child pedestrians can be avoided. Drivers in residential neighborhoods, school zones, and any other areas with children should proceed with due care and caution. Children do not always have the best of judgment or the best sense of danger when playing sports / games or when biking. Parental supervision is vital to the safety of children. Dangers of Heavy Unsecured Television Sets and Furniture to Small Children - 4 Year Old Girl Dies in Jacksonville Florida

Children suffer serious personal injuries and, in some cases, death as a result of unsecured furniture, appliances, and television sets. In Jacksonville, Florida, a four year old girl recently died when a large television set fell off a stand and on the girl. The Jacksonville Sheriff's Office indicates that the death appears to be an accident. An investigation will probably be conducted to determine more details as to the cause and manner of the death. This incident shows the importance of child proofing a home as to large television sets and appliances. It is quite tragic that the child lost her life from a television set. South Florida Christian Preparatory Student (Elizabeth Codie Lewis) Dies in Automobile Accident on Florida's Turnpikes - Negligence, Liability, and Seat Belts

In Florida and other States, class road trips to Universal Studios, Walt Disney World, and Sea World can be great fun. Some class road trips, however, turn out to be tragic. Recently a South Florida high school student (Elizabeth Codie Lewis - age 17) from South Florida College Preparatory School died in an automobile accident on the Florida Turnpike. She was the passenger in a vehicle driven by Livingston James Finely. Florida Highway Patrol reported that Finely probably fell asleep and lost control of the vehicle. Many others were injured in this crash as well.

No passengers were wearing a seat belt. It is disturbing that not one person was wearing a seatbelt. However, this may have no impact on a potential legal case. In order for the failure to wear a seat belt to be valid defense, it must be shown that there was an available and operational seat belt and that that seat belt would have more likely than not prevented an injury or lessened the severity of the the injury. If the impact of the accident would have caused Elizabeth to die anyway, the failure to wear a seat belt is irrelevant for a potential civil or insurance claim.

It is uncertain if this was a school sponsored trip or what kind of supervision was involved with this road trip. It is truly sad that a young high school student with some much promise lost her life on Florida roads.

Baby Dies After Being Thrown from a Car in Tampa, Florida

Tampa, Florida was the site of a heinous crime recently. A 21 year old man, Richard A. McTear, Jr., is being charged with first degree murder. During a fight with an ex girlfriend, McTear threw her 3 month son from his car out onto Interstate 275 in an area north of Downtown Tampa. McTear had previously beaten the girlfriend and the child at an apartment complex. A news photographer (Jason Bird) for WTVT-TV in Tampa, Florida located the body off of the expressway.

There was a history of domestic violence between McTear and the former girlfriend. This is truly a tragic end of life for an innocent 3 month old child.

Children should be kept out of domestic fights and domestic violence This incident shows the true danger of domestic violence to even the youngest of children.

Three Arrested for BB Gun Shooting of 6 Year Old in Palmetto, Florida

In Florida and Other States, BB Guns are used as weapons every day by children as well as adults. BB guns can cause serious person injuries to children including but not limited to eye injuries, facial injuries, bruising, welts, and other injuries.
In Palmetto, Florida, three people were arrested after a 6 year old boy was shot by a BB gun while riding a bicycle. The 6 year old victim was shot in his torso area between his waist and his underarm. Paramedics responded to the scene. Since there was a concern that a BB pellet or bullet may have entered the little boy's chest cavity, he was flown on an emergency basis to Bayfront Medical Center. The three criminal suspects all had BB guns as they were shooting at glass bottles. After the incident, some fled the scene and even tried to hid their weapons. Eventually, investigators were able to piece together the relevant facts and execute some arrests.

Whether a BB gun pellet or bullet hits a child by an intentional or an accidental shooting, it is still a dangerous situation that can lead to sometimes life threatening injuries. Parents should closely supervise their children if they have BB guns. Personally, my children will not be getting a BB gun as a present from me during any part of their lifetime. University of Florida Student Dies Surfing at Crescent Beach, Florida

In Florida other coastal States, even experienced swimmers and surfers die. Recently, a University of Florida student, Roland Earl Stiles, III, age 25, was found in the waters off of Crescent Beach after he was reported missing. He was taken to Flagler Hospital in St. Augustine, Florida where he was pronounced dead. Witnesses reported that Stiles went out beyond the breakers to catch some waves. When he was not seen by friends, there did not appear to be a cause to panic or worry since Stiles had been surfing his entire life. Later, a white surfboard was found without Stiles on it or nearby. Rescuers were called in for assistance. Unfortunately, Roland Earl Stiles, III died as a result of accidental drowning during this surfing outing. Federal Judge Criticizes St. Johns County School Officials for Teaching Religious Song in Public School

Judge Harvey Schlesinger criticized school officials for teaching third grade students a religious song. Of course, there is a debate whether the son "Chatter with the Angels" is a religious song in violation of the U.S. Constitution. The song was previously approved by the Florida Department of Education; however, approval by one government entity does not mean that the teaching the song is constitutional. Judge Schlesinger stated that he is relying on the promise made by the school board that the song would not be taught for the rest of the year. Judge Schlesinger ordered that the school board post his rulings on the district website and / or make the orders available to staff members / employees.

UNF (University of North Florida) Student in Coma After Road Rage Attack

In Jacksonville, Florida and other cities throughout the nation, road rage is a serious problem that can lead to catastrophic injuries and death. A Palm Bay, Florida mother has been by her son at his bedside in a Jacksonville, Florida hospital. Her son was seriously injured and suffered a skull / head injury following a road rage incident. Following a wild ride leaving a beaches nightclub, her son was viciously beaten. He suffered a fractured skull that involved bleeding and swelling that, in turn, put him into a coma. The police investigation is pending on this matter. No names have been released since no arrests have been made and the investigation continues.

Chiefland Man (Robert Wayne Thomas) Arrested for Sex Crimes Against Children

Odds are, these adults are up to no good. In Chiefland, Florida, Robert Wayne Thomas was arrested on two counts of lewd and lascivious conduct on a minor. Levy County Investigators are conducting further interviews to determine if Mr. Thomas committed any other crimes. Mr. Thomas threw parties for minors, served them alcohol, and had the children play games. He would even have the children in his bed. Mr. Thomas took a particular liking to one girl who was only 13 years old. Mr. Thomas expressed a desire to marry this child. The acts of Mr. Thomas were discovered when he kept in contact with the 13 year old target of his affections. He reportedly called her and sent her text messages on a daily basis. Anyone with information about the case or who suspects their child may have also been a victim is asked to call the Levy County (Florida) Sheriff's Office at 352-486-5111. More Timely Treatment for Abused 4 Year Old in Trenton, Florida Would Have Saved Her Life

In Florida, mothers and fathers are legally and morally responsible for the health, safety, and welfare of their child. It is quite sad when a young child loses his or her life when the child is abused or neglected by a parent. In Trenton, Florida. Kristina Hepp, a 4 year old girl, died as a result of both child abuse and child neglect. An autopsy and investigation by Dr. Martha Burt, Medical Examiner, concluded that Kristina's life could have been saved with more timely medical treatment.

Matthew Roland, age 23, was arrested and charged with aggravated child abuse and aggravated manslaughter of a child. Roland told investigations that he got into an argument with the child and spanked her. He also admitted to hitting the child with a belt.

Of course, Mr. Roland will be entitled to a legal defense on this case. Newspapers and web sites only include portions of the facts and information. It is difficult to detail all of the facts of a particular legal case in a newspaper article. The criminal case will not only depend on the harm done to the child but the apparent knowledge and actions of Mr. Roland. Did he inflict the injuries to the child that led to her death? Was Mr. Roland aware or should he have been aware of how seriously injured the child was? What were the particular injuries externally and internally by the child?

No matter the outcome of the criminal case - a young innocent 4 year old child died.

West Orlando Middle School Put on Lockdown After 6th Grade Brought 9mm Semiautomatic Weapon to School

All parents, teachers, and students should know by now that a school is no place for weapons including but not limited to knives and guns. Of course, a 9 mm semi-automatic handgun should not be brought to school. The presence of this gun around children can be a recipe for danger, personal injuries, and wrongful death. A 6th grader went to his middle school in west Orlando with a 9 mm handgun. Officers were called to the school and went to the classroom where the student was attending class. The officer safely separated the student from his backpack where they located the gun. The student acknowledged that there was a stolen gun in his back pack. The school along with police responded in a manner that was swift and controlled. Fortunately, nobody was hurt by the presence of this dangerous gun on school premises. I commend the police and school officials for taking care of this situation for the protection and safety of the students including the one that brought the gun to school. Smoke Alarms / Fire Alarms Save Lives - Family in Seminole County Saved by Fire Alarm

In Florida and Other States, simple safety measures like fire alarms and smoke alarms can be put in place to protect children from personal injuries and wrongful death. In Seminole County, Florida, a family is very thankful for its fire alarm that went off to warn the family of a fire that started in the garage. The family of four (mother, father, and two children) along with the family dogs were able to get out of the house to safety. The fire appeared to be electrical in nature. Vehicles on the Beach (Even Police Vehicles) Can Be Very Dangerous to Beach Goers - Annie Marie Griffin in Critical Condition

In Jacksonville Beach, Florida other beach towns and cities, police vehicles patrol the beach. A tragic incident recently took place on Jacksonville Beach. A police vehicle driven by Office Lewis Keller wa heading South on the beach when the officer stopped near 14th Avenue South and then made a U-Turn. There were witnesses to the incident who were disturbed and in disbelief over the incident. A full investigation will be completed. From early reports, it appears that the officer just did not observe Anne Marie Griffin, age 41, on the beach. There are many issues to consider when investigating this incident including but not limited to the following:

Was Ms. Griffin in a public area where beach goers / sun bathers were known to sun bathe?

What color clothing was Ms. Griffin wearing?

Were there other items with Ms. Griffin that would have given the officer better notice of her presence on the beach? Beach towels? Coolers? Umbrella? Bags? Other items?

Why is it that Officer Keller did not see Ms. Griffin on the beach?

Was a U-Turn permitted in this area? Was it common to make a U-Turn of this nature?

Of course, there are a host of other issues and questions to consider. Whatever the result of the investigation, it is most unfortunate that Ms. Griffin suffered the injuries she did while spending a leisurely day on the beach.

Florida law allows a person to bring a civil case against a government entity like Jacksonville Beach pursuant to Florida Statutes. The statutory cap for such a case is $100,000 unless the city has a higher amount of liability insurance. Furthermore, a special claims bill can be presented to the legislature to seek compensation over and above the $100,000.

School Bus Driver in Jacksonville, Florida Punches Andrew Jackson High School Student

School bus drivers have a duty to maintain control on the bus. This not only applies to the school bus driver's driving but also to the school bus driver's behavior and temper as well. Recently, a fight broke out on a school bus at Andrew Jackson High School. The school bus driver was speaking to another official about removing a student off the bus. At that point in time, the student began swearing at the school bus driver. At this point in time, there was some kind of contact between the student and the school bus driver.

There is a dispute as to the facts regarding this incident.

Did the school bus driver hit the student?

Did the school bus driver grab the student?

Was the school bus driver acting in self defense or in anger?

What were the injuries sustained by the student?

Which students were engaged in fighting or poor behavior on the bus?

Of course, the school bus driver has a right to legally or administratively defend herself on this matter if action is taken by the Duval County School Board or the Jacksonville Sheriff's Office.
