Florida Elementary Student Arrested for Bringing Semi Automatic Weapon to School

An 8 year old boy was arrested by Orlando - Orange County Sheriff's Office deputies for bringing a semi automatic weapon to school. The boy brought the gun to school to show off to his friends. He exhibited the gun at recess.

Jacksonville Residents Angered by Home Occupied by Multiple Sex Offenders

Jacksonville residents protested and rallied against a home where up to 6 registered sex offenders are residing. A company or group called the Philadelphia Christian Center owns the home and only commented that the home has met all legal requirements for Florida. Apparently, there are 15 children in the area of Wandering Trail, according to resident Diane Knowles. While no laws may have been broken, this news story shows the importance of being informed and aware of your neighbors especially those who have been identified as registered sex offenders. I did a search for 1 mile from my home. There were no registered offenders or predators in my direct neighborhood but there was one in a friend's neighborhood. I will be sure to inform my friend of the offender.

Jacksonville University Student (John Casey) Killed in Car Accident in Airplane Community

Jacob Casey, a University of North Florida student, died in a strange Florida automobile accident that took place on a private airport runway in Ocala. The single car accident involved a BMW and 5 occupants including Jacob.

Autistic Child Killed by Mother Who Confesses to Crime

Autistic children in Florida and in other States, including Illinois, deserve and are entitled to protection under the law from harm by other people, institutions, schools, and yes, in some instances, their parents.

A 3 years old autistic child was killed by her mother by suffocation with a garbage bag. Karen McCarron said that she loved her child - but hated the autism. McCarron attempted to kill her child three days before the murder but trying to use a pillow but was unsuccessful. I personally know three families who have an autistic child. There children are boys (a majority of autistic children are male and they have different abilities and varied development. The parents that I know love their children. While they are challenged by the curve ball in life that autism has thrown them, they all are doing their best to deal with these challenges. Jacksonville Florida YMCA Bus Driver Arrested on Molestation Charges

The Jacksonville Sheriff's Office arrested a former youth counselor and bus driver with the Dupont YMCA for charges of lewd and lascivious molestation following an investigation that began in May 2007. The former YMCA worker, Daniel Hardie, was reported in police records to have touched a 9 year old and a 7 year old on their genital through their clothing during separate incidents. Jacksonville Background checks were completed prior to employment prior to hiring Hardie. It would be interesting to see Mr. Hardie's personnel file to see if there were prior incidents and allegations. It would also be interesting to know Mr. Hardie's work and criminal history. Many offenders go undetected for years without police investigations and arrests. The families of the victims should be commended for coming forward with these charges. Florida Child Drownings: How to Prevent the Unexpected

The death or injury of a Florida child due to drowning is a tragic and, in many instances, an avoidable event. The United States Consumer Protection Commission disseminated a good article entitled How to Prevent the Unexpected - Preventing Child Drowning that every pool owner and parent should read in order to protect children. The report indicated that 300 children under the age of 5 die as a result of drowning in a swimming pool nationwide every year. Florida is a state that is populated with thousands of pools. I am a pool owner and have a child safety fence around my entire pool. While my children are good swimmers (they had lessons through an instructor and additional instruction by mom), I decided to keep my child safety fence up in the abundance of caution. My children have friends over and will get into horseplay. I know the swimming abilities of my children but not others. Jacksonville Florida Pastor's Sexually Explicit Text Messaging Leads to Charges in Sex Scandal

The Reverend Darrell Giyard, formerly with Shiloh Metropolitan Baptist Church located in Jacksonville Florida was charged with lewd and lascivious conduct for sending sexually explicit text messages to a 14 year old girl who was a member of his church. Apparently, Reverend Giyard resigned from a Texas church 16 years earlier for having affairs with church members. Reverend Giyard had a different message to spread than most church leaders. Unfortunately, he used his position of influence and power to take advantage of congregants including one that was only 14 years old. Churches like Shiloh are good for the community and the congregants. While Reverend Giyard's actions are embarassing for the church and community, Shiloh will persevere through these troubled times. While forgiveness is an important part of the Christian community, the victim and her family deserve more than forgiveness in this instance. The Church had the opportunity to take action against Reverend Giyard but failed to do so before policy intervention. Florida Statutes: Lewd and Lascivious Conduct Defined

You will often read stories about Florida sexual offenders and predators being arrested or charged with lewd or lascivious conduct on a child. In many instances, the child is physically and / or mentally injured as a result of this conduct.

Section 800.04 (6) defines lewd or lascivious conduct as follows:

(a) A person who:

1. Intentionally touches a person under 16 years of age in a lewd or lascivious manner; or

2. Solicits a person under 16 years of age to commit a lewd or lascivious act.

Orlando Florida 6 Year Old Injured After Falling Off ATV

An Orlando Florida 6 Year old was seriously injured after falling off an ATV. Jeremy Mincey, age 19, was operating the ATV which tipped over on top of the 6 year old. After the incident, Mincey tried to sneak away to avoid responsibility for incident which was witnessed by several people. Police arrived on the scene and arrested Mincey for child neglect and resisting an officer. It was reported that the girl may have spine or skull injuries. 6 Year Old Injured in ATV Accident.

Section 316.2074, Florida Statutes - All Terrain Vehicles - ATV requires that all persons under the age of 16 years old shall ride or operate an ATV without an approved helmet.

The 6 year old was not wearing a helmet at the time of the accident. As you can see by the tragic story in Orlando, it is important for a child to wear a helmet while on an ATV (All Terrain Vehicle), motorcycle, and bicycle. It is unknown if the child had permission from a parent to occupy the ATV.

Ocala Florida Man Faces Murder Charges in Death of Infant Cousin

An Ocala Florida man faces murder charges in the death of an infant cousin. The Marion County Sheriff's Office arrested Rishi Abraham Ramgoolie for the death of a 5 month old cousin that he was baby sitting. Mr. Ramgoolie gave two different accounts on how he discovered the infant coughing up blood. According to news reports, neither versions supported the physical or medical evidence regarding the injuries. The Dangers of Semi Tractor Trailers and Logging Trucks

An unfortunate trucking accident / automobile accident took place recently outside of Savannah, Georgia. Busy roadways in cities like Savannah Georgia and Jacksonville Florida are the sites of serious automobile accidents. A bus load of mentally handicapped people were hit by a logging truck. Florida Traffic Citations: They Are Not Generally Admissible in Civil Lawsuit

Florida law is well-established that evidence concerning the issuance of a traffic citation is inadmissible, and that erroneous admission of such evidence is grounds for a mistrial. My firm handled a case in 2000 where the Defense attorney suggested that his client did not get the citation.

The case went to a jury verdict and my firm appeared. We won the appeal since Florida law clearly prohibits the direct or indirect reference to a traffic citation in a civil case. This law was established to give each party and the the jury the ability to argue a case based on the merits and facts rather than the responding officer who in most instances did not witness the accident. The case we handled is reported at White v. Consolidated Freightways Corp., 766 So.2d 1228 (Fla. 1st DCA 2000).

Over the past 17 years, I have handled hundreds of Florida automobile accident cases. Usually, one driver gets a citation in Florida. Clients believe that this means that they will absolutely win the case at trial. I advise clients up front that the accident report and citation will not be admitted as evidence. However, the accident report and citation are usually submitted to the insurance company to show the adjuster who was at fault.

In addition to automobile accident cases, my firm handles traffic citations as well. Florida Dog Bites - Decreasing the Risk of Infection

According to a study (Prevention and Treatment of Dog Bites) conducted by the Mayo Clinic - Jacksonville, Florida, almost one half of Florida dog bites in Florida and other states involve the family dog or a neighbor's dog.

BB Guns Can Kill: Protect Your Children in Florida

BB guns and air powered rifles can cause serious personal injury and death to children. It is important that parents monitor the use of BB guns and air powered rifles in the possession or control of a minor. I personally have decided to refrain from such purposes. My kids play and argue with each other and friends all the time. I do not think that a BB gun or air powered rifle are smart purchases. The Consumer Product Safety Commission recommends that children under 16 refrain from using high velocity BB guns or pellet guns.

Lawsuits Can Be Filed for Death of Family Dog in Florida

In Florida and throughout the United States, dogs are considered part of the family. I read a recent story about a hunter / veterinarian (John A. Farah) who shot the dog of a woman (Teresa Wingate) in Nassau County Florida. Apparently, the dog slipped under a fence and Farah shot the dog. Civil monetary damages can be pursued for the death of an animal by a shooting or other reckless behavior. Florida law generally provides that a dog is like a piece of furniture. If a dog dies as a result of simple negligence, the damages are limited to the value of a dog. In other words, a dog owner can collect that it would cost to replace the dog versus what the dog meant to the owner. On the other hand, if the death of the dog was purposeful, reckless, or malicious in nature, a dog owner can pursue damages for the associated mental pain and suffering associated with the death of a dog. Human Body Parts Defendant Takes Deal in Criminal Case

A dentist who moonlighted in selling body parts has taken a deal in a criminal case in Seattle, Washington. Apparently, Michael Mastromarino plundered body parts from corpses without the permission or knowledge of the families of the decedents. One of the corpses was Alstair Cooke, former host of Masterpiece Theater, who died in 2004. Dr. Mastromarino made millions along the way.

Unfortunately, there was no screening for diseases or other details and many patients received tissue and body parts from unchecked and unscreened corpses. Angry Jacksonville Florida Customer Crashes into Restaurant

An angry Jacksonville Florida resident crashed his car into a local McDonald's restaurant because the cashier had previously made mistakes in his order. David Spillers later admitted that he was wrong for crashing his car into the playground and part of the building to McDonald's. "You want fries with that order . . ." is a common expression. Unfortunately, the cashier forget Mr. Spillers' order for french fries and this apparently upset Mr. Spillers. It does not appear that anybody was hurt at the time but the crash did go into part of the playground. As a parent and attorney, it made me think about the safety of the playgrounds being set so close to roadways and parking lots. Fatal Truck Accident on I-95 (Jacksonville Florida) Kills Truck Driver

A trucking accident on I-95 (Interstate 95) in Jacksonville Florida caused the death of a truck driver, Jeremy Garvin, of Gainesville. Apparently, the driver of another semi truck pulled into the emergency lane to allow for a driver switch. Fatal Fiery Crash Closes Interstate 95 Traffic for Several Hours. When the other driver was in the process of merging onto the highway, Jeremy Garvin hit the rear end of the other truck. A fiery crash resulted from the collision which in turn caused the death of Jeremy Garvin. Florida Highway Patrol will conduct a traffic homicide investigation to determine the cause of the crash. An autopsy will be performed to determine cause of death and if there was any drugs or alcohol involved in the crash.

I researched the issue of emergency lane usage in Florida and on the National Highway and Safety Transportation web site. I could not find direct authority on the use of emergency lanes. It does not appear the truck drivers or other drivers should randomly use emergency lanes to switch out drivers, take a bathroom break, or other activities which can be done at a rest stop or a nearby exit.

Jacksonville Florida Shooting Ends Life of Child Outside of Convenience Store

A Jacksonville Florida shooting killed Kiersten Ross outside of the Family Food Store shortly after 6:00 p.m. His mother, Pamela Ross, had last seen Kiersten riding his bike and playing with his toddler brother. Kiersten went to the Family Food Store to get a snack of donuts. As he was walking out of the store, he was shot by a drive by shooter. It is uncertain if Kiersten was the target. Investigation is under way to try to identify and locate the shooters.

The death of Kiersten, who was just 17 years old, is a tragedy for the family and the community. Kiersten was just at the store to buy donuts in the early evening hours.

Starke, Florida Police Arrest Jacksonville Man With Sexual Contact with a Minor

A Jacksonville Florida 19 year old man was arrested and charged with having sex with a minor between the ages of 12 and 15 in Starke Florida The Defendant, Malique R. Gamble, stated that he met the minor online and thought she was older. Mr. Gamble was caught in bed with the minor and the relatives called the police.

Jacksonville Florida Teacher Faces Punishment for Gagging a Student

A Jacksonville Florida teacher, Kasey Goodin, faces punishment for gagging a student. School officials had previously recommended a three day suspension for Ms. Goodin, a Kirby Smith Middle School teacher. The Jacksonville Duval County School Board, however, rejected this recommendation as being too lenient. Jacksonville Florida Atlantic Boulevard Single Car Crash Critically Injures Two Women

Jacksonville Florida has its share of weather changes and automobile accidents. According to Florida Highway Patrol, Sicilly Dye lost control of her vehicle on Atlantic Boulevard near Sutton Lake Boulevard. Jacksonville Florida Mom Finds Photos of Local Middle School on MySpace

A concerned Mother found photos of Jacksonville, Florida Fletcher Middle School children nude, in their underwear, and in bathing suits on a My Space page.

The Mother called local Jacksonville authorities about the discovery. Police officers have a possible suspect under investigation for these photos. In response to the reporting of this incident, Fletcher Middle School will be conducting an internet safety program about these issues. Parents, teachers, and children need to be educated on the risks and dangerous of the Internet. Sexual offenders and predators are on line every day looking for their next opportunity and victim. In addition, other children may view or use the information and photos posted on line for improper and offensive purposes as well. As parents, ask questions of your children, set rules for computer use, and yes - retain the ability to use all computers in your own and the ability to supervise and monitor your child's use of the computer. Florida McDonald's Halts Advertising in Seminole County Florida Schools

Florida McDonald's promoted its company on report card jackets at Seminole County Florida Schools. The promotion offered a Happy Meal to any child who brought home good grades. A parent complained and an organization called the Campaign for a Commercial Free Childhood got involved in the matter. McDonald's decided to halt this advertising campaign at the Seminole County Florida Schools. In the St. Johns County Florida School System, I have seen businesses promoted at the school. There are school board policies for advertising and promoting businesses. Some schools follow the policy better than others. Each county school board has its own policies and procedures. St. Johns County School Board Rules Manual is an example of policies and procedures in place for a school system. Most, if not all, other county school boards in Florida also have policies in place that can be viewed online. Do a Google search and locate the policies for your county.

I have read the policies and procedures for my children's school district. My review of these policies and procedures was very helpful in answering some questions I had about the school system and how things should be done.

If you believe that a school is violating a policy, you should first educate yourself and read the school board policies to see if the school has complied with the policies.

Allstate Insurance in Florida: State Insurance Commissioner Stops Allstate From Issuing New Automobile Policies

In Florida, Allstate Insurance is the second largest insurer of automobiles. State Farm is first in Florida. The State of Florida Office of Insurance Regulations had previously issued subpoenas requesting information and documentation for Allstate. Apparently, Allstate failed to comply with these requests and the Office of Insurance Regulation responded by stopping Allstate from issuing any further automobile insurance policies until Allstate complied with the subpoena request.

I have personally dealt with Allstate in the past. Allstate promotes itself as the "Good Hands" people. While Allstate is a long standing insurance company, Allstate is difficult to deal with in settling out personal injury, automobile accident, and homeowner's claims. In Florida, we drive our children just about everywhere. Advice to Florida Coaches - Get Training . . . Otherwise Children Get Injured

Florida coaches should get training especially when they are responsible for the supervision and guidance of children. Winning and competition are sometimes emphasized over safety and sportsmanship. This mentality can result in serious bodily as well as psychological injuries to children.

In Connecticut, football coaches were too zealous with their training and conditioning methods. In other to get several members of the team under the maximum weight for a Pop Warner 110 pound division, coaches put the children in garbage bags for drills to increase sweat and weight loss. While the conditioning methods were effective, it landed the coaches in jail for child endangerment.

Supervision and safety of our children are vital to their well being. I have handled numerous cases in which a child has been significantly injured or has died due to poor supervision or negligence maintenance of equipment and property.

Having a safe and healthy child is far more important than qualifying for or winning a game. I suggest that you attend practices with your children and speak with your children about their coaches and training. My daughter plays soccer in a local league. She was at a tournament out of town and had the privilege of playing in the championship match. The other coach told his team of 9 year old girls the following, "Second place is just another way of saying first place losers." I was appalled at such a statement. It really set a poor example for the children. No matter what our children do or win for that matter - we, as parents, should be supportive of our children. Coaches like this should have been shunned by the parents on his team, but parents (like coaches) get that mentality in their head to win at all costs. Well, in my opinion as an attorney and parent, winning is not everything. Safety and well being far outweigh the spoils of victory. Fatal Pedestrian Accident: Child Killed at Jacksonville, Florida Intersection (St. Augustine Road)

Busy Florida intersections can be dangerous to children crossing the road. In far too many accidents,injury and death to children could have been avoided with safer driving and precautions. There are several major roadways in Jacksonville which 4 or more lanes. One such roadway - St. Augustine Road - has 5 lanes in some areas. Unfortunately, St. Augustine Road was the site of a death recently here in Jacksonville. A group of children crossed the road with one child out in front. All the children but one made it safely across the road. Drivers should yield to children pedestrians and children should have adult supervision when crossing busy roadways. With all deaths on roadways, the Jacksonville Sheriff's Office and / or Florida Highway Patrol will conduct a thorough investigation of the accident.
